DEFINITIONS
“Company” means RightNow Home Warranty.
“Member” means the homeowner, seller, property manager, or entity purchasing coverage.
“Covered Property” means the residential property listed in the enrollment form.
“Service Fee” means the per-claim deductible selected ($99 / $125 / $150).
“Rapid Response Upgrade” means the optional $12.99/month add-on providing priority 4-hour dispatch (subject to availability).
“Same-Day Service” means service dispatch for claims submitted before 2:00 PM local time, subject to technician availability.
“Coverage Cap” means the maximum payout per system or appliance per agreement term.
TERM OF AGREEMENT
This Agreement is effective upon payment and continues for 12 months unless:
- Cancelled under Section 13
- Renewed annually
- Terminated for nonpayment
Monthly payment plans remain subject to a 12-month contractual commitment unless otherwise specified in writing.
COVERED SYSTEMS & APPLIANCES
Coverage includes mechanical failure due to normal wear and tear of:
Systems
- Heating system
- Air conditioning system
- Electrical system
- Plumbing system
- Water heater
- Ductwork
Appliances
- Refrigerator
- Oven / Range / Cooktop
- Dishwasher
- Built-in microwave
- Garbage disposal
- Washer & dryer (if selected)
- Garage door opener
Coverage caps are structured in line with leading national providers and defined in the Member Coverage Schedule attached at enrollment.
EXCLUSIONS
The following are not covered:
- Pre-existing conditions
- Cosmetic defects
- Structural components
- Roof leaks (unless optional add-on purchased)
- Code upgrades
- Improper installation
- Secondary damage
- Commercial property (unless property manager addendum applies)
SERVICE FEES
Members select one Service Fee tier:
The Service Fee is due per dispatched claim.
CLAIMS PROCESS
- Claims accepted 24/7 online or by phone
- Same-Day Service for claims submitted before 2:00 PM local time
- First-available appointment for standard members
- Rapid Response (4-hour dispatch target) available for upgraded members
Company reserves the right to determine repair vs replacement.
RAPID RESPONSE UPGRADE
For $12.99 per month per property:
- Priority dispatch
- Target 4-hour technician response
- Marked priority in dispatch queue
Upgrade does not guarantee parts availability or completion time.
WORKMANSHIP WARRANTY
All repairs include a 30-day workmanship warranty.
Extended workmanship protection may apply for eligible upgraded plans.
$75 ANNUAL MAINTENANCE CREDIT
Each covered property is eligible for:
- Up to $75 per contract year
- Reimbursement for documented HVAC maintenance
- Proof of service required
Credit does not roll over.
TRADE GUARANTEE
If a repair fails within 30 days due to workmanship error, the Company will correct the issue at no additional Service Fee.
REALTOR & PROPERTY MANAGER ADDENDUM
Realtor Program:
- $75 per activated plan
- Deductible waived promotional option (Company discretion)
Property Manager Program:
- Portfolio pricing
- Bulk enrollment permitted
- Dedicated support channel
PAYMENT TERMS
Members may select:
- Monthly billing
- Annual billing (8% discount applied)
Failure to pay may result in suspension.
CANCELLATION
Members may cancel:
- Within 30 days for full refund (if no claims filed)
- After 30 days, pro-rated refund less administrative fee
- Immediate cancellation for nonpayment
LIMITATION OF LIABILITY
Company liability shall not exceed the coverage caps per system per contract term.
Company is not liable for consequential, incidental, or secondary damages.
ARBITRATION CLAUSE
Any dispute arising from this Agreement shall be resolved through binding arbitration in the State of Missouri under applicable arbitration rules.
Members waive the right to jury trial.
GOVERNING LAW
This Agreement shall be governed by the laws of the State of Missouri.
For Illinois service properties, applicable consumer protection provisions shall apply where required.
ENTIRE AGREEMENT
This document, along with enrollment forms and coverage schedule, constitutes the entire agreement between parties.
